1. Acceptance of Terms
By accessing or using SwapStudio ("the Service"), you confirm that you are at least 18 years of age and that you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Age Requirement
SwapStudio is an adult platform. You must be 18 years of age or older to register and use the Service. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts of users who misrepresent their age.
3. Permitted Use
You may use SwapStudio only for lawful purposes. You agree that you will not:
- Upload or process images or videos of real individuals without their explicit consent.
- Create, distribute, or use content depicting minors in any sexual or exploitative manner.
- Use the Service to harass, defame, or harm any individual.
- Create non-consensual intimate imagery (NCII) of any person.
- Attempt to circumvent any security, access control, or content moderation measures.
- Reverse engineer, copy, or resell the Service or its outputs for commercial redistribution.
4. Consent Responsibility
You are solely responsible for obtaining the explicit consent of all individuals whose likeness appears in any content you upload or process. SwapStudio does not verify consent and is not liable for any misuse. By submitting content, you represent that you have all necessary rights and consents.
5. Credits and Payments
SwapStudio operates on a credit-based system. Credits are purchased in packages and deducted per job. Purchased credits expire 6 months from the date of purchase. Free credits granted on signup expire after 30 days. Credits are non-refundable except as required by applicable law.
6. Content and Intellectual Property
You retain ownership of all content you upload. By using the Service, you grant SwapStudio a limited, non-exclusive license to process your content solely for the purpose of delivering the Service. We do not store your output files permanently — processed results are available for download for a limited period and then deleted.
7. Prohibited Content
The following content is strictly prohibited and will result in immediate account termination and may be reported to law enforcement:
- Any content involving minors in a sexual or exploitative context.
- Non-consensual intimate imagery of real individuals.
- Content designed to defame, extort, or harm a specific individual.
- Content that violates any applicable law or regulation.
8. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, without prior notice. Upon termination, your remaining credits are forfeited and your access to the Service is revoked.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, error-free operation, or specific output quality. Use of the Service is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, SwapStudio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or reputational harm.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
